If you have been wondering why you cannot get your hands on vaping materials such as pods and flavored eliquids, it’s most likely that the state you live in has several vape laws in effect. Here is a comprehensive list of the federal and state specific restrictions and bans in place.
FEDERAL VAPING LAW – EFFECTIVE FEBRUARY 1, 2020
- ALL pre-filled vape cartridges and pre-filled pod flavors are banned EXCEPT for tobacco and menthol.
- Refillable vape pods, eliquid, open tank devices and disposables are not impacted by federal regulations.
NEW JERSEY VAPE BAN – EFFECTIVE APRIL 20, 2020
- ALL flavored juices, pods and eliquid are banned EXCEPT tobacco flavor.
NEW YORK VAPE BAN – EFFECTIVE MAY 18 2020
- ALL flavored pods, eliquid and disposables (including menthol) are banned EXCEPT tobacco flavor.
- Online sales of all eliquid and all disposable vapes INCLUDING tobacco and menthol flavor are prohibited. This does not include devices and components. (Effective July 1, 2020)
- Pharmacies are no longer allowed to sell any tobacco or nicotine product that isn’t an approved smoking cessation therapy. (Effective July 1, 2020)
RHODE ISLAND VAPE BAN
- ALL flavored eliquid, pods and cartridges are banned EXCEPT tobacco flavor.
- Devices and accessories not effected.
- These rules apply to online orders.
MASSACHUSETTS VAPE BAN
- Only tobacco flavor with a strength of 3.5% or less is permitted
SAN FRANCISCO, CALIFORNIA VAPE BAN – EFFECTIVE JULY 1, 2019
- All vape and vapor products are banned.
- These rules apply to online orders.
- This not a state wide ban, but an ordinance signed by the Mayor of San Francisco, CA.
ARKANSAS VAPE BAN
- Arkansas law bars all sales of tobacco and nicotine products online, requiring purchases to be in person and over the counter to ensure that children do not obtain the products.
UTAH VAPE BAN
- In Utah, a business can only sell tobacco products, electronic cigarette products, or nicotine products to a customer in person, meaning a business cannot sell any of these products to a Utah customer by telephone, mail, the internet, or through self-service displays. There are two exceptions to this law:
- Tobacco retailers are allowed to sell tobacco products, electronic cigarette products, or nicotine products by telephone, mail or the internet only to buyers who have a tobacco license.
- Retail tobacco specialty businesses are allowed to have self-service displays, such as vending machines.
